1. Acceptance of the Terms

By accessing our website, its subdomains, or any related services (hereinafter collectively referred to as the "Site"), you agree to be legally bound by these Terms of Use (the "Terms"), as well as our Privacy Policy, Cookie Policy, and Legal Notice, all of which are incorporated herein by reference.

By creating an account, registering for a competition, participating in Cash Matches, playing in Ranked mode, or using any other feature of the Site, you represent and warrant that:

you have read, understood, and accepted all applicable terms and conditions;
you are at least 18 years old at the time of registration;
you are accessing and using the services from a jurisdiction where your participation is not prohibited or restricted by law.

If you do not accept these Terms in their entirety, you are not authorized to use the Site or its Services. Any unauthorized or non-compliant use may result in the suspension or deletion of your account without notice.

We reserve the right to modify these Terms at any time. Any material changes will be communicated via publication on the Site or by email. By continuing to use the Site after such changes, you are deemed to have accepted the updated Terms.

2. Description of Services and Features

Winalia is a competitive gaming platform designed to allow players to compete in structured environments where performance, strategy, and skill determine the outcome of each match. Users may engage with the platform in two primary formats: Cash Matches and Ranked Mode.

a. Cash Matches

Cash Matches are head-to-head or team-based competitions in which each participant contributes a predetermined entry amount. The winner(s) receive the entire prize pool, minus a service fee charged by Winalia.

Cash Matches are not gambling, games of chance, or sports betting. The outcome of each Cash Match is determined exclusively by the players' skill, strategy, reflexes, and in-game mastery. No random element or external factor influences the result.

This format qualifies legally as a skill-based competition, and is recognized in many jurisdictions as a lawful alternative to games of chance. It is the same model used by several established operators in the competitive gaming sector.

Each Cash Match involves:

Voluntary participation from all users involved;
A clearly defined stake, visible prior to match start;
An outcome determined solely by player performance.

This format is intended for users who are seeking high-stakes gameplay in which performance is directly rewarded.

b. Ranked Mode

Ranked Mode allows players to compete free of charge in a progressive, performance-based ranking system. No deposit is required.

At the end of each competitive season, the top-ranked players receive rewards such as:

W-Coins (the platform's internal currency, which can be spent or converted);
Gift cards
Or other digital or physical rewards determined by Winalia.

Ranked Mode is a central pillar of the platform, founded on the following principles:

Meritocracy: rankings are based solely on in-game results;
Accessibility: no payment is required to play or progress;
Transparency: rankings are publicly visible and updated in real time;
Competitive integrity: limited-time seasons are followed by resets to ensure fairness.

Through Ranked Mode, every player has the opportunity to climb the rankings and earn rewards --- without ever risking real money.

c. Additional Features

Winalia also provides a suite of complementary features to enhance the user experience, including but not limited to:

Occasional tournaments (free or entry-based);
An ELO or equivalent ranking system
Seasonal challenges and rewards
A reputation or profile badge system
A dedicated individual performance dashboard
A store for spending W-Coins or purchasing cosmetics
And moderation and support tools to ensure a smooth and secure experience.

These features may evolve over time and are subject to updates, modifications, or replacement as the platform develops.

3. Eligibility and Geographic Restrictions

Access to and use of the services offered by Winalia are subject to age, jurisdiction, and local law compliance requirements. Each user is responsible for ensuring that they are legally permitted to participate in the platform's features from their country of residence.

a. Minimum Age Requirement

Registration on the Winalia platform and participation in its features (Cash Matches, tournaments, Ranked mode, shop, etc.) are strictly reserved for individuals who are at least 18 years old at the time of account creation.

By creating an account on Winalia, the user represents and warrants that they are at least 18 years old and legally capable of entering into a binding agreement under applicable law.

Winalia reserves the right to request proof of age or identity at any time in case of doubt or as part of a withdrawal process. Any account suspected of being owned by a minor may be suspended or permanently deleted without notice.

b. Territorial Restrictions

Certain jurisdictions restrict or prohibit participation in competitions involving entry fees or skill-based games with financial rewards.

Winalia explicitly prohibits access to Cash Matches for users located in the following countries or territories (non-exhaustive list, subject to change):

United States: States such as Arizona, Louisiana, Montana, and Iowa prohibit skill-based cash competitions. Users located in these states are not permitted to participate in Cash Matches;
Countries subject to international sanctions: North Korea, Iran, Syria, Cuba, etc.;
Other countries where authorities prohibit or heavily regulate cash competitions based on skill.

Access to the Ranked mode remains available to users in most jurisdictions, as it does not require any financial stake and is solely based on game performance.

By using Winalia, users acknowledge they have verified the legality of their participation based on their country of residence. They agree to use the platform at their own risk and release Avenis from any liability in the event of non-compliance with local laws.

c. Identity Verification and Compliance

When a user accumulates €100 or more in total winnings, or in case of suspected fraud, Winalia reserves the right to initiate an identity verification process, which may include:

A valid government-issued ID;
Proof of residence;
Ownership documentation for the payment method used.

Failure to cooperate within a reasonable time may result in account suspension or closure and a temporary freeze of funds until the matter is resolved.

4. Account Creation, Security, and Responsibilities

Creating a Winalia account is a prerequisite to accessing the platform's features. Users agree to provide accurate, up-to-date, and complete information and to ensure the confidentiality of their login credentials.

a. Account Registration

To access Winalia's services, users must create an account and provide personal information, including:

A unique username;
A valid email address;
A secure password.

Winalia may request additional information for specific operations (e.g., withdrawals, participation in certain tournaments, age or location verification).

The user guarantees that the information provided is truthful and agrees not to create a false account or use someone else's identity without authorization.

b. Credential Confidentiality

Users are solely responsible for maintaining the confidentiality of their login credentials and agree to:

Not disclose their password to any third party;
Not allow others to access their account;
Immediately notify Winalia in case of any suspected or unauthorized access.

Winalia disclaims any liability for misuse resulting from the user's negligence in protecting their credentials.

c. One Account Per User / Non-Transferability

Each user is limited to one active account. It is strictly forbidden to:

Create multiple accounts to bypass rules or limits;
Sell, lend, or transfer an account to another person;
Use an account on behalf of another individual.

Violations of these rules may lead to immediate account suspension, forfeiture of any rewards, and potential legal action.

d. Account Inactivity

An account is considered inactive if no login has occurred for a period of 180 consecutive days.

In such cases, Winalia reserves the right to:

Notify the user of the inactivity;
Apply a monthly inactivity fee of up to €1.99 (deducted in W-Coins);
Close the account after an additional 90-day period, subject to prior email notification.

Remaining funds or W-Coins in an inactive account may be forfeited if no action is taken within the allotted time.

e. Conduct and Acceptable Use

By using the platform, users agree to:

Respect common rules of courtesy when interacting with others;
Refrain from disrupting the platform's operation (e.g., spamming, cheating, using scripts);
Not attempt to bypass technical or security measures.

Any abusive or unlawful behavior may lead to disciplinary actions, including temporary or permanent bans and legal proceedings in case of serious breaches.

5. Platform Features

Winalia offers a variety of competitive game modes and features that allow users to compete, progress, and earn rewards based on their skill and performance. All features are accessible through an active user account.

a. Cash Matches

Cash Matches are 1v1 duels in which both players voluntarily stake an identical amount. The winner receives the total prize pool, minus a service fee charged by Winalia (5% per player).

These matches:

Are open to all eligible users with sufficient balance;
Are based solely on skill and performance --- not chance or random outcomes;
Are not considered gambling or sports betting under applicable laws, including the definitions provided by the French National Gambling Authority (ANJ).

Match results are validated either via automated API integration, player-submitted proof, or manual review by Winalia moderators in case of disputes.

Winalia reserves the right to monitor matches, suspend players suspected of cheating, or cancel any match in case of clear rule violations.

b. Tournaments

Tournaments allow multiple users to compete in bracket-based or round-robin formats. Some are free; others require an entry ticket in W-Coins.

Rewards may include:

W-Coins, gift cards, or other pre-announced prizes;
Rankings based on wins or final placement;
Public or semi-public leaderboards.

Users are responsible for reviewing each tournament's specific conditions before joining.

c. Ranked Mode (Free and Merit-Based)

Ranked Mode is a cornerstone of Winalia's ecosystem. It allows users to:

Play competitive, skill-based matches against similarly ranked opponents;
Progress on a seasonal leaderboard (using an ELO or equivalent system);
Earn end-of-season rewards such as:
- W-Coins (in-platform currency usable or convertible as per the Terms of Use),
- Gift cards,
- Other physical or digital prizes designated by Winalia.

This system provides a completely free and inclusive alternative to paid modes, where players are rewarded based purely on merit. Rankings reset at the start of each season, with historical data available.

d. Winalia Shop

The Shop allows users to redeem W-Coins (earned via Ranked or Cash Matches) for various items and services, including:

Gift cards (PSN, Xbox, Amazon, etc.);
Branded merchandise;
Exclusive platform perks (skins, badges, etc.).

Winalia may modify or discontinue shop items at any time without prior notice.

e. Deposits and Withdrawals

Users can deposit or withdraw funds using supported payment methods (PayPal, crypto, etc.).

Minimum deposit: defined by the payment method selected.
Minimum withdrawal: 10 W-Coins.
Processing times:
- Less than 24 hours for VIP members,
- Up to 3 business days for standard users.

Winalia reserves the right to initiate identity verification (KYC) when cumulative winnings exceed €100 within a rolling period.

Fees and commissions (if any) are disclosed before each transaction.

6. Eligibility and Territorial Restrictions

a. Age and Legal Capacity Requirements

Access to Winalia's services is strictly limited to individuals who are18 years of age or older and have the legal capacity to enter into a binding contract under the laws of their country of residence.

By registering on Winalia, you represent and warrant that:

You are at least 18 years old at the time of account creation;
You are using the platform on your own behalf and not on behalf of a third party;
You are not subject to any legal restriction preventing you from participating (e.g., guardianship, conservatorship, court-imposed gambling bans);
You do not reside in a jurisdiction that prohibits or restrictsthe activities offered by Winalia.

b. Territorial Restrictions

Winalia's services are not available to residents of territories where skill-based competitions with monetary rewards are prohibited or subject to specific regulatory constraints.

Winalia prohibits account creation, participation in Cash Matches or paid tournaments, and withdrawal requests from users located in any of the following jurisdictions (non-exhaustive list, subject to updates based on legal developments):

Countries or U.S. States that explicitly ban skill games for money
Jurisdictions subject to international economic sanctions
Other territories specified in the FAQ or individual tournament rules.

It is your responsibility to verify the legality of your participation in Winalia services based on your local laws. In case of a violation, Winalia reserves the right to suspend or terminate your account without refund.

c. Nature of Competitions

Winalia offers competitions based solely on player skill, including:

Cash Matches, where two players place an equal stake, and the winner receives the prize pool minus Winalia's commission;
Ranked mode, a completely free system in which the highest-performing players each season are rewarded based on leaderboard rankings.

Winalia does not offer games of chance, random draws, sports betting, or casino-style activities. The outcome of each match is determinedexclusively by user performance, with no element of luck involved.

Therefore, Winalia's services do not fall under French or EU gambling regulations requiring ANJ (Autorité Nationale des Jeux) authorization.

d. Zero Tolerance for Underage Use

Winalia enforces a strict zero-tolerance policy regarding underage access. Any attempt to circumvent age restrictions---such as false identity, account misuse, or unauthorized payment methods---may result in:

Immediate account termination
Forfeiture of any winnings
Legal action if applicable.

Winalia reserves the right to conduct identity and age verificationat any time, especially when processing withdrawal requests or investigating suspicious behavior.

7. User Code of Conduct

Use of Winalia's services is subject to rules of conduct that ensure a fair, respectful, and secure gaming environment. Any violation may result in permanent suspension of the account without notice or refund.

a. Fair Play and Competitive Integrity

Every user agrees to:

Participate in Cash Matches, Ranked, and tournaments honestly and without cheating
Play personally in all competitions (no account sharing or ghost-playing);
Refrain from using bugs, third-party software, bots, scripts, or macros;
Not fix matches, collaborate with opponents, or manipulate outcomes;
Not tamper with the ELO ranking system or exploit reward mechanics.

Any attempt to gain an unfair advantage, financial or otherwise, is strictly prohibited.

b. Identity, Accounts, and Security

Users must:

Provide accurate and verifiable information at registration;
Protect login credentials and refrain from sharing their account;
Maintain only one personal account
Not impersonate another user or a Winalia representative;
Immediately report any unauthorized access or suspicious activity.

Multiple, borrowed, or fake accounts may be suspended without warning.

c. Behavior and Communication

Users must behave respectfully in all interactions, including chat, profiles, and Winalia's affiliated networks.

The following are strictly prohibited:

Hate speech, discriminatory or defamatory language;
Harassment, threats, insults, provocation, or toxicity;
Content of a sexual, violent, political, or religious nature;
Spam, unsolicited advertisements, or commercial solicitations without written authorization from Winalia.

Although communication tools are monitored after the fact, violations may trigger immediate disciplinary action.

d. Cheating, Fraud, and Technical Circumvention

Winalia has zero tolerance for cheating, including:

Use of cheating software, wallhacks, aimbots, or any external aid;
Boosting or allowing skilled players to use your account to improve rankings or earnings;
Attempts to bypass deposit, withdrawal, or identity verification systems;
Fraudulent transactions, including the use of stolen or unauthorized payment methods.

Consequences may include:

Immediate forfeiture of winnings
Permanent account ban
Civil or criminal legal action where applicable.

9. Cash Matches and Commission Structure

a. Definition and Principles of Cash Matches

Cash Matches are competitive online games where players compete in either 1v1 duels or team-based formats. Each participant wagers a pre-agreed amount using W-Coins, Winalia's internal virtual currency. The winning player or team receives the total prize pool, minus a service commission charged by Winalia.

These matches are based exclusively on skill, strategy, and gameplay performance, with no element of chance involved. This model falls under the legal category of Skill-Based Competitions, distinguishing it clearly from games of chance or sports betting.

b. Operational Mechanics

Eligible Match Types:

1v1 Matches: Two players compete head-to-head;
Team Matches: Two teams of multiple players face off (e.g., 2v2, 3v3, 5v5 depending on the supported game formats).

Wagering and Payouts:

Each player or team member wagers a set amount in W-Coins (e.g., 10 W-Coins per player);
The winning player or team receives 95% of the total prize pool(e.g., 19 W-Coins out of 20 in a 1v1 match);
Winalia collects a fixed 5% commission per player.

Service Commission:

This commission is used to cover:

Technical infrastructure (servers, anti-cheat systems, etc.);
Human moderation and dispute resolution;
Continuous improvements to matchmaking and platform features.

Payout Processing:

Winnings are automatically credited in W-Coins once the match result is validated;
In case of dispute, proof of victory (e.g., screenshot, match replay) may be requested by Winalia moderators.

c. Security, Fairness, and Moderation

Winalia implements advanced security and monitoring tools to ensure fair play:

Automated cheat detection systems and behavioral analytics;
Human moderators for impartial resolution of disputes;
Strict sanctions in cases of fraud, cheating, collusion, or any rule violation.

Suspicious behavior may result in:

Match cancellation;
Forfeiture of winnings;
Account suspension or termination.

d. Eligibility for Cash Matches

To participate in Cash Matches, users must:

Be at least 18 years old at the time of registration;
Have a verified and active Winalia account
Fully accept and comply with the Terms of Use.

Access to Cash Matches may be restricted or suspended based on:

The user's behavioral history on the platform;
Applicable legal or geographic restrictions;
Winalia's discretion, for security or compliance reasons.

10. Ranked Mode and Rewards

a. Definition and Operation of Ranked Mode

Winalia's Ranked Mode is a free competitive ranking system where players can face each other and climb the leaderboard based on performance. No monetary stake is required to participate.

Each season, users engage in online matches that allow them to earn or lose ranking points (ELO or equivalent). The ranking system is based solely on skill, consistency, and merit, with no random factor involved.

Ranked Mode is a cornerstone of the Winalia ecosystem, designed to give all players an opportunity to earn rewards purely through gameplay without spending money.

b. Reward Distribution

At the end of each season, Winalia distributes both tangible and digital rewards to top-performing players on the leaderboard. Rewards may include (but are not limited to):

W-Coins, which can be used to enter Cash Matches or request withdrawals;
Gift cards (e.g., Steam, PlayStation, Xbox);
Partner products or services
Other season-specific rewards defined by Winalia.

Reward formats, values, and eligibility conditions may vary between seasons. Full details are transparently published on official platform pages prior to each new season.

c. Advantages of Ranked Mode

Ranked Mode offers multiple benefits:

Full accessibility: free-to-play, open to all verified accounts;
Merit-based progression: rankings are influenced solely by match results;
Continuous growth: players can climb the ladder with each match;
Recognition: top players receive visibility in public leaderboards and may access VIP roles or partnership opportunities.

d. Ranking Integrity and Oversight

Winalia ensures the transparency and integrity of the ranking system through:

Automated detection of abnormal behavior (e.g., match-fixing, multi-accounting);
Manual review system for suspicious cases;
Partial or full leaderboard resets in case of proven fraud;
Sanctions, including account deletion, for any breach of competitive fairness.

11. W-Coins Virtual Currency System

a. Definition of W-Coins

W-Coins are the exclusive virtual currency used on the Winalia platform. They may be:

Acquired through deposits in euros or cryptocurrencies;
Earned through participation and performance in Ranked competitions;
Granted as part of promotional events organized by Winalia.

W-Coins have no legal value outside of the platform. They may only be used within the Winalia ecosystem for designated services (e.g., Cash Matches, purchases in the store, or withdrawals subject to conditions).

b. Use of W-Coins

W-Coins may be used to:

Pay entry fees for Cash Matches;
Request withdrawals, subject to the conditions outlined below;
Purchase items and rewards listed in the online store, when available.

Any transfer, resale, or exchange of W-Coins outside of Winalia is strictly prohibited. Winalia reserves the right to suspend or terminate the account of any user who violates this policy.

c. Withdrawing W-Coins

Users may convert their W-Coins into euros or cryptocurrency by submitting a withdrawal request, provided that the following conditions are met:

A minimum balance of 10 W-Coins
Completion of identity verification, if cumulative winnings exceed a threshold set by Winalia (e.g., €100).

Withdrawal requests are typically processed within three (3) business days, except for VIP accounts, which benefit from processing in less than 24 hours.

Processing fees may apply depending on the chosen withdrawal method. These fees will be clearly displayed at the time of the request.

d. Validity and Expiration

W-Coins do not expire as long as the account remains active.

However, Winalia reserves the right to remove the W-Coins balance from accounts deemed inactive for a period exceeding 12 consecutive months, unless the user explicitly expresses their intention to retain their balance before the deadline.

12. Deposit and Withdrawal Terms

a. Deposits

Users may fund their Winalia account using the payment methods accepted by the platform, including:

Bank cards (Visa, Mastercard, etc.);
E-wallets (e.g., PayPal);
Cryptocurrencies accepted by Winalia.

All deposits are converted into W-Coins at a fixed exchange rate (1 W-Coin = €1), unless otherwise stated on the deposit page.

Deposits are final: no refunds will be issued unless due to an error attributable to Winalia or a legal right of withdrawal applicable to eligible users.

Winalia reserves the right to set a minimum deposit amount, which is displayed on the relevant deposit page.

b. Responsibility for Payment Methods

The user certifies that they are the legitimate owner of any payment method used for deposits. Any fraudulent use will result in theimmediate suspension of the account and may be reported to the relevant authorities.

Winalia reserves the right to request proof of identity or ownershipof the payment method at any time, especially in the event of suspicious behavior or unusually high deposits.

c. Withdrawals

Withdrawals are allowed from a minimum balance of 10 W-Coins and may be processed via the following methods, subject to availability and approval by Winalia:

Bank transfer
E-wallets (e.g., PayPal);
Cryptocurrencies.

Before authorizing a withdrawal, Winalia may require:

Identity verification (especially if cumulative winnings exceed a platform-defined threshold);
Proof of the legitimacy of funds, in compliance with anti-money laundering (AML) and counter-terrorism financing (CTF) regulations.

Standard processing times are:

Up to 3 business days for regular accounts;
Under 24 hours for VIP members.

d. Withdrawal Blocking or Refusal

Winalia reserves the right to temporarily or permanently block a withdrawal in the following cases:

Violation of the Terms of Use, or suspected fraud, cheating, or rule circumvention.

In all cases not involving potential criminal offenses, the user will receive a written explanation via email. In cases involving suspected criminal activity, Winalia may suspend the account without prior notice.

13. VIP Membership

13.1. Subscription

Winalia offers an optional "VIP" membership designed to enhance the user experience through exclusive benefits. This membership may be purchased:

Either via a €3.95 (VAT included) payment processed through our approved payment providers;
Or by spending 5 W-Coins, Winalia's internal currency (1 W-Coin = €1).

The VIP membership is valid for 30 consecutive days from the date of activation. Once the purchase is confirmed, the subscription becomes active immediately and is non-refundable, except as required by applicable law.

13.2. VIP Benefits

Subject to future changes, the VIP subscription currently includes the following benefits:

An exclusive VIP badge, visible on the user's profile and in the rankings;
Priority processing for withdrawal requests and customer support inquiries;
1 free customized avatar, non-transferable and limited to one per season;
5 free Snipes: Snipes allow the user to preview their opponent before confirming a Cash Match, offering a strategic advantage;
Reduced match result validation time: 3 minutes instead of 5 for standard users.

Winalia reserves the right to add, modify, or remove any of the above benefits at any time, particularly for reasons of balance, technical maintenance, or product evolution. No compensation will be issued for changes or removals of benefits.

14. Purchase of Digital Goods (Cosmetics and Virtual Items)

Winalia operates a virtual store where users can purchase cosmetic items (avatars, badges, profile decorations, etc.) either using their W-Coins balance or via euro (€) payments. These items are purely visual and haveno impact on gameplay performance in Cash Matches or Ranked mode.

14.1. Nature of Goods

Items offered for purchase are non-refundable, non-transferable, and strictly linked to the user's account. These are digital goodswithout any physical representation.

14.2. Pricing

Prices for cosmetics vary based on rarity and seasonal availability. Prices may be expressed as follows:

In euros, starting from €1.00
In W-Coins, based on a scale set by Winalia (e.g., a common avatar may cost 1 to 3 W-Coins).

14.3. Purchase Conditions

Purchases are final upon confirmation, whether through an external payment method or via W-Coins. No refunds will be issued, even in cases of account deletion or voluntary deactivation by the user.

14.4. Exceptions

Winalia reserves the right to remove or temporarily disable certain store items without notice, for example during seasonal rotations or for technical reasons. Such removals do not entitle the user to any refund or compensation.

15. Limitation of Liability

15.1. Platform Availability and Operation
Winalia is accessible 24/7, except in cases of force majeure, events beyond the control of Avenis, or interruptions necessary for the proper functioning of the service (maintenance, updates, technical improvements, etc.).

Winalia shall not be held liable for interruptions, malfunctions, delays, or the temporary impossibility of accessing all or part of its services where such events result from:

Maintenance or updates to the platform;
Issues related to the Internet network or third-party infrastructures;
Cyberattacks, viruses, or any malicious actions;
Cases of force majeure under French or European law.

15.2. Disclaimer of Warranty
The Winalia platform, its features, its services (including Cash Matches, Ranked mode, leaderboards, etc.), and its content are provided "as is" and subject to availability.
No express or implied warranty is given regarding:

The absence of errors, bugs, or interruptions;
Service continuity;
The fitness of the service for a particular purpose;
The potential gain or loss of W-Coins, or any outcome of Cash Matches or Ranked competitions.

Winalia does not warrant that results or performance on the platform will be error-free or undisputed. Decisions of administrators or internal referees are final, subject to the remedies set forth in these Terms and Conditions.

15.3. Financial Liability Limitation
To the extent permitted by law, Avenis (publisher of Winalia) shall not be held liable for any direct or indirect damages suffered by the user, including but not limited to:

Loss of opportunity;
Loss of earnings;
Loss of data;
Material or immaterial damages;
Harm to reputation or image.

Winalia's total liability, regardless of cause, is limited to the total amount paid by the user to Winalia in the twelve (12) months preceding the claim.

15.4. User Responsibility
Each user is solely responsible for their use of the site and its consequences. In particular, the user undertakes not to:

Attempt to circumvent site rules or security mechanisms;
Use bots, automation software, or any tool intended to gain an unfair advantage;
Transmit unlawful, defamatory, offensive, or otherwise illegal content.

Any breach of these obligations may result in suspension or termination of the account, without notice or compensation.

15.5. Links to Third-Party Services
Winalia may contain links to websites or services operated by third parties. These links are provided for informational purposes only. Winalia exercises no control over such third-party services and disclaims any responsibility for their content, privacy policies, or operation.

16. Intellectual Property

16.1. Protected Elements
The Winalia platform, its structure, source code, interfaces, databases, algorithms, visuals, texts, graphics, logos (including the Winalia logo), multimedia content, and all elements composing or associated with it are the exclusive property of Avenis, or of its partners where applicable.
These elements are protected by French and international intellectual property law, including the French Intellectual Property Code and applicable international treaties.

16.2. License of Use
Registration and use of the Winalia platform do not grant the user any ownership rights over the aforementioned elements. A personal, non-exclusive, non-transferable, and revocable license is granted to the user, strictly limited to access to Winalia's services for private use in compliance with these Terms.
In no case is the user authorized to:

Reproduce, copy, modify, distribute, display, sell, rent, transfer, publish, or commercially exploit any part of the site or its elements;
Use the Winalia brand, logos, or names without Avenis's prior written authorization;
Reverse engineer, decompile, or extract the source codes, databases, or algorithms used by the platform;
Create a competing or derivative platform by replicating or reusing components of Winalia.

16.3. Ownership of User-Generated Content
Users may create or transmit content via the platform (nickname, avatar, messages, images, match recordings, etc.).
By publishing such content on Winalia, the user grants Avenis a worldwide, free, non-exclusive, transferable, and sublicensable license to:

Host, display, distribute, modify, adapt, and publish such content on the platform or any digital medium;
Promote the platform, its features, or competitions (including via social networks or partner media), unless expressly opposed by the user.

The user guarantees that they hold all necessary rights to the content they publish and undertakes not to share unlawful, infringing, or third-party rights--violating content. Avenis reserves the right to remove any content without prior justification, particularly in the event of a breach of these Terms.

16.4. Respect for Third-Party Rights
Winalia respects third-party intellectual property rights. In the event of a claim relating to content hosted on the platform, any third party may send a substantiated notification to legal@winalia.gg, along with the necessary supporting documents. The claim will be processed as quickly as possible.

16.5. Disclaimer Regarding Game Publishers
Winalia is an independent platform and is neither affiliated with, sponsored by, nor endorsed by the publishers or rights holders of the games mentioned or used by its users, including but not limited to Epic Games, Riot Games, Activision Blizzard, EA, Ubisoft, or any other publisher.
The names of games, trademarks, logos, images, graphic elements, or gameplay mechanics visible on the platform are the exclusive property of their respective owners and are used solely for descriptive or informational purposes, in accordance with applicable legal exceptions (e.g., citation exception, fair use, or description of a compatible third-party service).
Winalia does not modify, reuse, resell, or exploit the games concerned. Its role is limited to connecting third-party players for friendly or competitive matches, outside any framework of betting or casino activities.
In the event of a legitimate takedown request or objection by a rights holder, Winalia undertakes to cooperate in good faith, while reserving the right to challenge any manifestly unfounded request.

17. Suspension and Account Termination

17.1. Grounds for Suspension or Termination
Winalia reserves the right to temporarily or permanently suspend access to all or part of the platform's services, including the deletion of a user account, without prior notice, in the event of:

Violation of these Terms of Use;
Fraudulent use or attempted cheating (multi-accounting, spoofing, score manipulation, etc.);
Toxic or disrespectful behavior toward other users, including via chat, social networks, or during matches;
Use of unauthorized bots, scripts, or automation tools;
Submission of false information during registration or verification procedures;
Failure to comply with applicable laws in the user's country of residence;
Prolonged inactivity of the account (see paragraph 17.3).

The sanction applied (warning, temporary suspension, permanent termination) is at Winalia's sole discretion depending on the seriousness of the breach.

17.2. No Refund in Case of Ban
In the event of permanent banning or suspension due to a violation of these Terms, no refund of payments, W-Coins, or benefits obtained shall be due to the user. Any remaining amounts on the account are deemed irrevocably forfeited to Winalia as a contractual penalty for abusive termination.

17.3. Prolonged Inactivity
Any user account that has not been accessed for a consecutive period of 365 days may be considered inactive. Winalia reserves the right to:

Delete the account and all associated data, including the W-Coins balance; or
Apply a monthly management fee of 1 W-Coin (deducted only from accounts with a non-zero balance), until deletion.

A notification by email or upon reconnection may be sent to the user before account deletion.

17.4. Voluntary Account Deletion
The user may request the permanent deletion of their account at any time by submitting a written request to support@winalia.gg. Such deletion is irreversible and results in the permanent loss of W-Coins, profile data, history, and associated benefits.

18. Intellectual Property

18.1. Ownership Rights
All elements present on the Winalia platform, including but not limited to:

Trademarks, trade names, logos, slogans, graphics, visual identity, illustrations, animations, interfaces, icons, sound elements, videos, and design elements;
Editorial content, texts, publications, guides, tutorials, service descriptions;
The Ranked system, matchmaking infrastructure, proprietary algorithms, and user interfaces;
W-Coins, avatars, cosmetics, and any virtual items accessible on the site;
Tournament structures, participation rules, scoring systems, and gameplay modes offered,

are the exclusive property of Winalia (Avenis SAS) or are subject to exclusive or non-exclusive exploitation rights, and are protected under French and international laws relating to intellectual property, copyright, databases, and patents.

18.2. Personal Use License
The user is granted a personal, non-exclusive, non-transferable, and revocable right to use the Winalia platform, under the conditions set forth in these Terms. This license does not confer any intellectual property rights on the user.
Any use not expressly authorized is strictly prohibited, including:

Any reproduction, representation, modification, adaptation, translation, extraction, reuse, commercialization, republication, or communication to third parties, even in part;
Any attempt at reverse engineering, system copying, or unauthorized access to or exploitation of platform data by circumvention or other means.

18.3. User-Generated Content (UGC)
By publishing content on Winalia (profile text, image, username, custom avatar, suggestion, chat message, or any other contribution), the user grants Winalia a free, non-exclusive, worldwide, and transferable license to use, represent, modify, adapt, reproduce, and distribute such content in the normal operation of the platform, for commercial or non-commercial purposes, for the legal duration of the rights.
The user warrants that they hold the necessary rights to the content they publish and undertakes not to post any content that is:

Infringing, discriminatory, abusive, threatening, obscene, misleading, or unlawful;
Violating third-party rights (copyright, trademarks, privacy, image, etc.);
Containing advertising or spam.

Winalia reserves the right to delete any content without notice, at its sole discretion, and to initiate legal proceedings if necessary.

18.4. Reporting Infringement
Any person who believes that content on Winalia infringes their rights may report such infringement to legal@winalia.gg. A response will be provided as soon as possible, in accordance with French law and applicable procedures.

19. Limitation of Liability

Winalia makes every effort to ensure the accessibility, security, and proper functioning of its platform. However, the user acknowledges that access to the site may be temporarily interrupted for technical reasons (maintenance, updates, incidents, etc.).

Winalia shall not be held liable for:

Any damage resulting from a temporary service interruption;
Technical malfunctions beyond its control (server, host, network, etc.);
Data loss caused by a technical incident or by user behavior;
Delays or failed payments caused by banking errors or external providers;
Fraudulent use of a user account in cases of negligence in managing login credentials.

In no event shall Winalia's liability exceed the amounts actually received by the user in the context of validated withdrawals.

20. Governing Law and Jurisdiction

These Terms of Use are governed by French law.
In the event of a dispute, jurisdiction shall lie with the courts of the jurisdiction of Avenis SAS's registered office, unless mandatory provisions provide otherwise.

Before initiating legal action, the parties agree to seek an amicable resolution. Winalia provides a dedicated support system at support@winalia.gg.

21. Severability

If one or more provisions of these Terms of Use are found invalid or declared as such under a law, regulation, or final court decision, the remaining provisions shall remain fully enforceable.

22. Waiver

The fact that Winalia does not invoke a user's breach of any obligation under these Terms of Use shall not be construed as a waiver of its right to invoke such breach at a later date.

23. Amendments to the Terms

Winalia reserves the right to amend these Terms of Use at any time, in particular to adapt them to legal, regulatory, technical, or functional developments of the service.

Users will be informed of such amendments by any appropriate means. Continued use of the service after the amendments take effect constitutes acceptance of the new Terms. In case of disagreement, the user may close their account.
